In what ways do you assess your clients’ mental capacity?
Face to face meeting with qualified staff members to assess capacity in a dignified but professional way. Where doubts exist then work with clients gp or other professionals to have a written assessment produced.

What processes do you follow to avoid undue influence?
No family members in the room when giving instructions. Couples always offered opportunities to have separate meetings if they wish. Fully documented instruction process which records obvious signs.

What do you offer as part of your will-writing service?

Full fact find. Options explained to clients. Work with other professionals to design a plan for the successful transition of wealth between generations.

Do you prompt your clients to consider leaving gifts to a charity? If so, how?
Yes. Our literature for clients includes information about our support for the firms charity of the year. It then states if they want to give to this charity or other charities then to raise this with us. We always encourage a disaster provision to default to charity.

What provision does your service make for secure Will storage or future access?
We store wills in our vaults free of charge. Clients are sent a physical copy of the will and also a pdf copy emailed to them. Our portal system when live will allow clients to log in to a secure area and see electronic copies of documents (including wills) whenever they want.

How is your service delivery regulated?

What formal protection have you got in place for your clients, e.g. liability insurance for will-writing or provision of legal advice, please specify level of coverage?
Professional indemnity insurance mandatory for SRA regulated firm. Our PII is extended to £25m to cover the value of matters we deal with.

Are you able to track impact and report on progress e.g. how many inquiries lead to Wills and how many include a charitable gift? How do you do it?
Case management system produces MI reports on number of leads, number of conversions, average revenue per transaction, number of cross sales of LPAs etc., average time from instruction to signing etc.

How does your product deal with / identify complex Will structures e.g. where legacy is 2nd death contingent gift?
Will software package deals with this.

Are you able to determine customers demographic information e.g. an average age of your client?
Yes. We profile clients on a number of metrics not just age.

If working with a partner charity, are you able to provide monthly activity reports?
If requested to, yes.
