Best practice for legacies updated in new code

The new Code of Fundraising Practice has now been published by the Fundraising Regulator. Allowing a transition period, these new standards will take effect from 1st November 2025.
At Remember A Charity, we are pleased to welcome the new Code, which streamlines the rules for fundraising and offers clear guidance for demonstrating best practice in all areas of fundraising. The regulator has also published accompanying guidance on relevant issues including due diligence, documenting your fundraising decisions and working with partners.
Changes relating to legacies include the requirement for charities to have procedures in place to deal with any situation where a potential testator offers a personal legacy to a fundraiser, and new rules for face-to-face events and interactions.
For charities working with Will-writing partners, the new Code also specifies the need for clarity and transparency, requiring charities to communicate clearly about the level of legal advice provided through any such partnership.
