Change to legacy section of the new Code of Fundraising Practice

The Fundraising Regulator has announced a change to the legacies section of the new Code of Fundraising Practice, which will come into effect at the start of November 2025. The update has been made to the explanatory information of section 14.3.3, covering Will-writing partnerships.
In this section of the Code, the regulator emphasises the need for charities working with Will-writing partners to provide clear information about the service being offered and the testator’s options.
Initially, the explanatory information for the new Code stated that charities needed to give testators at least two ‘partners’ to choose from. Following queries raised by Remember A Charity and others, the regulator has changed the wording from ‘partners’ to ‘providers’, requiring charities to give the testator ‘at least two providers to choose from, without providing a recommendation.’
With this update, the regulator aims to clarify that charities are not required to hold formal partnerships with multiple providers, but rather to ensure that supporters have choice, and that they understand an alternative Will-writing option is available.
For charities with one Will-writing partner, this could mean making supporters aware of the option to write a Will through a local solicitor or other such means.
This change to the legacy section is one of three updates to the incoming Code announced by the regulator earlier this month.
